EOLYS BEAUTE is the publisher and operator of the www.minimaliste.green website.

The present General Terms and Conditions of Sale govern all contracts concluded from the website accessible at the URL address: https://www.minimaliste.green. They are concluded between EOLYS BEAUTE, registered in the Lyon Trade and Companies Register under number Lyon B 529 046 054, represented by François-Xavier Laude in his capacity as President, on the one hand, and the non-professional individual customer on the other.

The Customer and EOLYS BEAUTE will be collectively referred to as the Parties. Any order placed on the www.minimaliste.green website implies the customer's unreserved acceptance of these general terms and conditions of sale. Consequently, the consumer acknowledges that he/she has been fully informed that his/her agreement to the content of these terms and conditions does not require the handwritten signature of this document, insofar as the customer wishes to order online the products presented in the website boutique. The consumer has the option of saving or editing these general terms and conditions, it being specified that both saving and editing of this document are the sole responsibility of the consumer. Prior to placing an order, the consumer declares that the acquisition of these products is not directly related to his professional activity, their acquisition being reserved for his personal use. As a consumer, the customer therefore has specific rights, which would be called into question in the event that the products or services acquired through the website were in fact related to his or her professional activity.

The online store set up by EOLYS BEAUTE within the framework of the website includes the following information:

1. legal notice enabling precise identification of the company EOLYS BEAUTE.

2. presentation of the essential characteristics of the goods offered.

3. indication, in Euros, of the price of the goods, as well as, where applicable, delivery charges.

4. indication of terms of payment, delivery or performance.

5. the existence of a right of withdrawal.

6. the period of validity of the offer or price.

7. the conditions for terminating the contract when it is open-ended or for more than one year.

8. All this information is presented in French. The consumer declares that he/she has full legal capacity to enter into the present terms and conditions.

Article 1 : Entirety

The present general conditions express the entirety of the obligations of the parties. In this sense, the consumer is deemed to accept without reservation all the provisions of these general conditions. No general or specific condition appearing in documents sent or delivered by the consumer may be incorporated herein, insofar as such documents are incompatible with these general conditions.

Article 2 : Purpose

The purpose of these general conditions is to define the rights and obligations of the parties in the context of the online sale of goods and services offered by EOLYS BEAUTE to the consumer.

Article 3: Changes to the GTCS

EOLYS BEAUTE may modify these GTC at any time. The Customer will be informed of the nature of these modifications as soon as they are put online on the https://www.minimaliste.green website. The modifications will come into effect 1 day after their posting on the site. Only the GCS published on the day of the order are applicable. They are brought to the customer's attention at the time of the order placed by the customer, who will have accepted them before any confirmation of the latter.

Article 4 : Contractual documents

The present contract is formed by the following contractual documents, presented in descending hierarchical order: the present general terms and conditions; the order form. In the event of contradiction between the provisions contained in documents of different rank, the provisions of the document of higher rank shall prevail.

Article 5: Entry into force - duration

The present general conditions come into force on the date of signature of the order form. The present general conditions are concluded for the duration necessary for the supply of the goods and services subscribed, until the extinction of the guarantees due by the company EOLYS BEAUTE.

Article 6 : Products offered

Presentation of products online. All products are described by the company EOLYS BEAUTE as precisely as possible according to the information communicated by the suppliers. In case of doubt about the characteristics of a product, the customer can contact EOLYS BEAUTE at 04 37 64 47 57. EOLYS BEAUTE cannot be held responsible for any insubstantial difference between the photograph of products on the site and the product ordered. The company EOLYS BEAUTE presents on its website the products to be sold with the necessary characteristics that allow compliance with Article L 111-1 of the Consumer Code, which provides for the possibility for the potential consumer to know before the final order the essential characteristics of the products he wishes to buy.

Stock limits.

The products ordered and the promotional offers proposed by EOLYS BEAUTE are only valid while stocks last.

Product offers and prices are valid only as long as they are visible on the site and within the limits of available stocks.

Article 7 : Order confirmation

Contractual information will be confirmed by e-mail at the latest at the time of delivery or, failing this, at the address indicated by the customer on the order form.

Article 8 : Proof of transaction

Computerized registers, kept in EOLYS BEAUTE's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. Order forms and invoices are archived on a reliable and durable medium that can be produced as proof.

Article 9 : Prices

All orders placed on the www.minimaliste.green website are payable at the time of ordering. Product prices may change at any time depending on EOLYS BEAUTE's pricing policy. Products ordered are invoiced at the price in force when the order is registered. Delivery charges are fixed according to destination. Prices are indicated in Euros, all taxes included, excluding shipping and handling costs. The prices shown include the VAT applicable on the day the contract is concluded. Any change in the rate may be reflected in the price of products. If a price error appears on the site and a customer places an order, Eolys beauté reserves the right to cancel the order and reimburse the customer. The customer must then place a new order with the correct prices.

Article 10 : Method of payment

To pay for his order, the consumer has, at his choice, all the payment methods mentioned in the order form. The consumer guarantees the company EOLYS BEAUTE that he/she has the necessary authorizations to use the method of payment chosen by him/her when validating the order form. The company EOLYS BEAUTE reserves the right to suspend any order management and any delivery in the event of refusal of authorization of payment by bank card on behalf of the officially accredited organizations or in the event of nonpayment. In particular, EOLYS BEAUTE reserves the right to refuse to make a delivery or to honor an order from a consumer who has not paid in full or in part for a previous order, or with whom a payment dispute is in progress. EOLYS BEAUTE has set up an order verification procedure designed to ensure that no one uses another person's bank details without their knowledge. As part of this verification, the customer will be asked to fax EOLYS BEAUTE a copy of an identity document and proof of address. The order will be validated only after receipt and verification by our services of the documents sent.

Article 11 : Product availability

The order will be executed at the latest within 10 days from the day following that on which the consumer placed the order. In the event of unavailability of the product ordered, notably due to our suppliers, the consumer will be informed as soon as possible and will have the option of cancelling the order. The consumer will then have the choice of requesting either a refund of the sums paid within 30 days of their payment, or an exchange of the product.

Article 12 : Delivery terms

Products are delivered to the address indicated by the customer on the order form. The customer is obliged to check the conformity of the goods delivered at the time of delivery. Any anomalies concerning the product must be indicated immediately upon delivery and as soon as possible (within 3 days). The consumer may, at his request, have an invoice sent to the billing address and not to the delivery address, by validating the option provided for this purpose on the order form. As far as shipping is concerned, we work mainly with Colissimo Suivi. As soon as your order is dispatched, you will immediately receive an e-mail informing you.

To keep shipping costs as low as possible, all small and medium-sized products are shipped by Colissimo Suivi. In addition to being cost-effective, this service delivers within 48 hours anywhere in France, and gives you the option of picking up your order at a post office close to the delivery address, should you be absent when the letter carrier arrives. Specifically, if you are absent on the day of delivery, your letter carrier will leave a delivery notice in your letterbox, allowing you to collect your parcel from your post office during opening hours, within 15 days. Colissimo Suivi is a highly reliable service. However, as with any shipment, there may be a delay in delivery or the product may go astray. In the event of a delay in delivery in relation to the date we indicated in the dispatch e-mail, we ask you to inform us of this delay by calling us by telephone or by sending us an e-mail. We will then contact the Post Office to start an investigation. A Poste investigation can last up to 21 days from the date the investigation begins. If the product is found during this period, it will be sent to your home address immediately (in most cases). If, on the other hand, the product is not found at the end of the 21-day investigation period, the Post Office considers the parcel lost. Only then can we send you a replacement product, at our expense. If the product(s) ordered are no longer available at this time, we will reimburse you for the amount of the products affected by the carrier's loss. If the product(s) is (are) still available, but has (have) changed its (their) selling price(s) on the site, we will apply the new selling price(s), either by reimbursing you by cheque for the difference, or by requesting an additional cheque for the price difference. Any error or modification made by the customer in a current delivery order will result in an extension of the delivery time. In the event of stock shortage, EOLYS BEAUTE reserves the right to deliver a product of equivalent quality and price.

Article 13 : Delivery problems caused by the carrier

Any anomaly concerning the delivery (damage, missing product compared to the delivery note, damaged parcel, broken products...) must be indicated on the delivery note in the form of “handwritten reserves”, accompanied by the customer's signature. At the same time, the consumer must confirm this anomaly by sending a registered letter with acknowledgement of receipt to the carrier within 3 working days of the delivery date, setting out the aforementioned complaints. Article 14: Delivery errors

14-a : The consumer must notify EOLYS BEAUTE on the day of delivery, or at the latest on the first working day following delivery, of any claim of error in delivery and/or non-conformity of the products in kind or in quality compared to the indications on the order form.

14-b : The formulation of this complaint with the company EOLYS BEAUTE could be made: - in priority by telephone in 04 37 64 47 57 from Tuesday till Saturday from 9h30 till 12h30 and from 14h till 17h30 - or via the form of contact of the site by specifying the reference of the order.

14-c : Upon receipt of the complaint, EOLYS BEAUTE will indicate the procedure to follow in order to proceed with the return. 14-e: In the event of a delivery or exchange error, any product to be exchanged or reimbursed must be returned to the company EOLYS BEAUTE in its entirety and in its original packaging, if possible by Colissimo Recommandé, to the following address:

Article 15: Product warranty

a) Description of legal warranties

Legal warranty of conformity - In accordance with articles L. 217-3 et seq. of the French Consumer Code, the Vendor is obliged to deliver a Product which conforms to the order placed by the Buyer, and is liable for any defects in conformity existing at the time of delivery of said Product, appearing within a period of two (2) years from the date of delivery.

The Vendor is also liable, during the same period, for defects in conformity resulting from packaging.

This warranty period applies without prejudice to articles 2224 et seq. of the French Civil Code. The starting point for the prescription of the Buyer's action is the day on which the Buyer becomes aware of the lack of conformity.

Under the legal warranty of conformity, the Product must, in particular, in order to conform to the contract:

1° Correspond to the description, type, quantity and quality or any other characteristic provided for in the contract;

2° Be fit for any special purpose intended by the Buyer, made known to the Seller at the latest at the time of conclusion of the contract and accepted by the latter;

3° Be delivered with all accessories to be supplied in accordance with the contract.

In addition to the criteria of conformity to the contract, the Product is in conformity if it meets the following criteria:

1° It is fit for the use normally expected of goods of the same type, taking into account, where applicable, any provisions of European Union and national law as well as all technical standards or, in the absence of such technical standards, specific codes of conduct applicable to the sector concerned;

2° Where applicable, it possesses the qualities which the Seller has presented to the Buyer in the form of a sample or model, prior to the conclusion of the contract;

3° If applicable, it is delivered with all the accessories, including packaging, that the Buyer may legitimately expect;

4° It corresponds to the quantity, quality and other characteristics, including in particular in terms of durability and safety, that the Buyer may legitimately expect for goods of the same type, having regard to the nature of the Product as well as to public statements made by the Seller, by any person upstream in the chain of transactions, or by a person acting on their behalf, including in advertising or on labelling.

However, the Seller shall not be bound by any public statements mentioned in the preceding paragraph if he demonstrates:

1° That he was not aware of them and could not legitimately have been aware of them ;

2° that, at the time the contract was concluded, the public declarations had been rectified in conditions comparable to the initial declarations; or

3° That the public statements could not have influenced the purchasing decision.

The Purchaser may not contest conformity by invoking a defect concerning one or more particular characteristics of the Product, which he was specifically informed deviated from the conformity criteria set out above, a deviation to which he expressly and separately consented when the contract was concluded.

With the express exception of specific products, the Vendor does not provide any commercial warranty within the meaning of Article L. 217-21 of the French Consumer Code.

Legal warranty against latent defects - Likewise, in accordance with article 1641 of the French Civil Code, the Vendor is bound by a warranty against latent defects in the item sold, which render it unfit for its intended use, or which impair this use to such an extent that the Purchaser would not have purchased it, or would have paid a lower price for it, had he or she been aware of them.

The action resulting from redhibitory defects must be brought by the Buyer within two (2) years of the discovery of the defect.

b) Procedure to follow

If the Products delivered do not conform to the Products ordered by the Buyer, or if they have hidden defects, the Buyer must send an e-mail to the Seller's Customer Service Department here to notify it of the non-conformity or hidden defects of his Product(s).

The Seller's Customer Service will acknowledge receipt of the Buyer's request and confirm the procedure to be followed. Upon receipt of the instructions from the Vendor's Customer Service, the Buyer shall return the non-conforming or damaged Product(s) to the Vendor at the following address:

The Product(s) must be (i) returned, at the Vendor's expense, complete, unused (except in the case of a hidden defect), in its (their) original, undamaged packaging and (ii) as far as possible, accompanied by its (their) original packaging as well as the return slip and a photocopy of the invoice.

Moreover, the Vendor does not accept packages sent carriage forward. All risks associated with the return of the Product(s) are the responsibility of the Vendor.

On receipt of the Product(s) presumed to be non-conforming or affected by a hidden defect, the Vendor will carry out an inspection of the Product(s) to ascertain whether or not they are in conformity. Similarly, the Vendor may carry out a quality test on the Product(s) returned by the Buyer to verify that the Product(s) returned are indeed original Product(s). It is understood that these checks are carried out as quickly as possible and within a maximum period of one (1) month.

c) Content of legal warranties

If the non-conformity of the Product(s) is confirmed or the defect is proven: the Buyer may choose between repairing or replacing the Product, subject to the cost conditions set out in article L. 217-12 of the French Consumer Code. It should be noted that the Buyer (i) has a period of two (2) years from delivery of the Product in which to take action, and (ii) is exempt from proving the existence of the Product's lack of conformity during the twenty-four (24) months following delivery of the Product.

In the event of the Buyer invoking the warranty against hidden defects in the item sold under article 1641 of the French Civil Code, he/she may choose between rescission of the contract or cancellation of the Product.

Article 16 : Right of withdrawal

a) Notification to the Vendor of the decision to withdraw

The Buyer has the right to withdraw from the contract within fourteen (14) clear days, without having to give reasons or pay penalties. This withdrawal period expires fourteen (14) clear days after the day on which the Buyer, or a third party designated by the Buyer other than the Carrier, takes physical possession of the Products. If the Buyer has ordered several Products in a single order, or if the Products have been delivered in several parts, the withdrawal period does not begin until the Buyer, or a third party designated by the Buyer other than the Carrier, takes physical possession of the last Product or the last part of the delivery. To exercise his right of withdrawal, the Buyer must send his decision to withdraw to the Seller by any unambiguous statement before the expiry of the withdrawal period, in particular:

In this case, upon receipt of the form by the Seller, the Seller will acknowledge receipt of this request by sending an email or letter. In order for the withdrawal period to be respected, it is sufficient for the Buyer to transmit his communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.

b. Return of Products subject to withdrawal

Following communication by the Purchaser of his/her decision to withdraw, the Purchaser must return to the Vendor the complete, unused Product(s), in its (their) original, undamaged packaging and, where possible, accompanied by its (their) original packaging, as well as the return slip and a copy of the invoice, without undue delay and at the latest within fourteen (14) days of the Buyer's decision to withdraw, to contact@eolys-beaute.com. This deadline is deemed to have been met if the Products are returned before the fourteen (14) day withdrawal period has expired. If the Products are not returned within fourteen (14) days of the Buyer's decision to withdraw, no reimbursement will be made.

c. Refund of Products subject to retraction

The Vendor undertakes to reimburse the Purchaser for all sums paid, including delivery costs (with the exception of additional delivery costs arising from the fact that the Purchaser has chosen, where applicable, a delivery method other than the less expensive standard delivery method proposed by the Vendor). Unless the Buyer expressly agrees to another means of reimbursement, the Product(s) will be reimbursed according to the original method of payment used by the Buyer, without undue delay and, in any event, no later than fourteen (14) days from the date on which the Vendor is informed of the Buyer's decision to withdraw. This reimbursement will not incur any costs for the Buyer. The reimbursement of this sum may however be deferred until the actual recovery of the returned Products or until the Buyer has provided proof of shipment of the Product, whichever comes first. The Buyer is informed that Products unsealed after delivery and which cannot be returned for reasons of hygiene or health protection cannot benefit from the right of withdrawal (in particular, and without this list being considered exclusive, cosmetic products from which the lid has been removed).
